Terms and Conditions of Use for Services

1. Your relationship with our Services

1.1 Unless otherwise agreed upon in writing with the Editor, relationships between the editor and you are governed at all times and in all cases by the terms and conditions set out in these GTCU.

1.2 In addition to these GTCU, your relationship with the editor will also be governed by the stipulations applicable to the Services, in addition to the GTCU, hereinafter referred to as the “Additional Terms and Conditions”. Once a Service is subject to the Additional Terms and Conditions, they will be communicated directly in the Service or in the context of your use of this same service.

The GTCU and the Additional Terms and Conditions are a legally binding agreement between JOBIJOBA SA and you, applicable when you use the Services. It is important that you take the time to read them carefully. This legal agreement is hereinafter collectively referred to as the “Terms and Conditions”.

Applicable law and competent courts

These Terms and Conditions of Use are subject to French law and are written in French. In case of translation into other languages, the French version shall prevail between the parties.

In case of dispute regarding the application of these GTCU and more generally the use of the service, only the French courts shall have exclusive jurisdiction.

2. Acceptance of Terms and Conditions

2.1 Before using the Services, you must first accept these Terms and Conditions. You cannot use the Services unless you first accept the Terms and Conditions.

2.2 You can accept the Terms and Conditions either by:

(A) Clicking, which signifies your acceptance of the Terms and Conditions, where this option is offered by JOBIJOBA SA in the user interface of the Service;

(B) Or by actually using the Services. In this case, you acknowledge and accept that this use will then be considered by JOBIJOBA SA as acceptance of the Terms and Conditions.

2.3 You can neither use the Services nor accept the Terms and Conditions if (a) you are not of legal age to enter into a contract with JOBIJOBA SA, or (b) if the legislation in force in France or other countries (including the country where you reside or from which you use the Services) prohibits you from using then.

2.4 Before you continue, we strongly advise you to print or save a copy of the Terms and Conditions.

3. Provision of Services by JOBIJOBA SA

Services are provided by JOBIJOBA SA free of charge and therefore are not paid for.

They are provided for an indefinite period. Consequently, JOBIJOBA SA may cease, without notice and at its sole discretion, permanently or temporarily, to provide all or part of the Services or its functions, to you or to users.

Similarly, you can stop using the Services at any time without being obliged to inform us.

Services are in principle accessible 24h a day and 7 days a week. However, given the complexity of global networks and affluence at certain hours of Internet users, the editor cannot guarantee the continuity of the service and cannot therefore be held liable in case of temporary disruption in the provision of all or part of the Services.

4. Use of Services

4.1 Access to certain Services requires that you provide information about yourself (such as your identity or contact details) as part of the registration process for the Service or in the context of your use of jobijoba.co.uk. All information provided to the Editor of jobijoba.co.uk for registration purposes must always be accurate, correct and up to date. 5. Security of your account and passwords

5.1 When creating your account, you will be assigned a username and password. Given the confidential information contained in this account, you shall agree to keep these passwords strictly confidential and not disclose them to third parties. Any use of your account with these passwords will be deemed to have been made by you and you will therefore be held liable.

5.3 If you become aware of any unauthorised use of your password or account, you must immediately inform the Editor of jobijoba.co.uk at abuse@jobijoba.com

6. Personal data

Personal data collected through the jobijoba.co.uk website is collected and processed in accordance with the provisions of Law No. 78-17 of 6 January 1978 called the Data Protection Act. The data controller is JOBIJOBA SA.

On the forms concerned, required fields are marked by an asterisk. Your application will not be processed if you do not complete these required fields.

Data collected in the “Create your CV” form is solely used to enable you to edit and post your CV using the services of jobijoba.co.uk site.

This data can be sent or communicated to partners of the jobijoba.co.uk website once you check the box provided for this purpose. “Partners” are the job sites and recruitment agencies offering CV bank consultation services to recruiters.

Data collected in the “Contact us” form are solely used to process contact requests.

Data collected from the “Newsletters” form are solely used to send out our newsletter.

Data collected through this website will also be used for statistical purposes.

In accordance with the above-mentioned law, you have the right to access, correct or delete your personal data, as well as the right to object to the collection of your data. To exercise these rights, you can send your request to the following address: contact@jobijoba.com

7. Data retention

Your data is kept for a maximum of 2 years from the last date of interaction with our services; unless explicitly requested by the customer to delete the data after processing.

After this time, your data is deleted from our databases and our daily backups.

8. Content of Services

Content posted by you

You acknowledge that all information (such as data files, texts, software, music, audio files or others, photographs, videos or other images) which you can access as you use the Services is the sole responsibility of the person who posted this content. All such information is hereinafter referred to as the “Content”.

The Editor does not check the relevance, veracity or accuracy of the information and data (the Content) that you post on the Internet when using the Services, as these elements are your own responsibility.

Regarding such content, the Editor therefore does not intervene as a content editor. His role and responsibility is limited to that of host as defined by the provisions of the Law on Confidence in the Digital Economy of 21 June 2004.

However, the Editor reserves the right to delete information and data if he believes that their content is illegal, does not conform to the regulations in force and / or is likely to affect third parties.

As such, you shall agree to guarantee the legality of elements and information posted and you may not use the Services to perform an illicit or illegal activity, contrary to public order and / or good morality.

Content posted by third parties

Job offers presented within the Services are provided and checked directly by the editor’s partners and are not subject to any verification or control by the latter.

The Partners are solely responsible for this information. The editor cannot be held liable for errors, inaccuracies or vagueness.

9. Ownership rights

9.1 You acknowledge and accept that the Editor of Jobijoba holds all ownership rights to the Services, including all intellectual property rights on the Services (regardless of the territory of protection and whether these rights have been registered or not). You further acknowledge that the Services may contain information deemed to be confidential by the Editor of Jobijoba and you are forbidden to disclose such information without the prior written consent of the Editor of Jobijoba.

9.2 Unless expressly agreed upon in writing with the Editor of Jobijoba, no provisions of these Terms and Conditions give you the right to use the trade names, trademarks, service marks, logos, domain names and other distinctive signs of the Editor of Jobijoba.

9.3 In the event that you signed a separate agreement with the Editor of Jobijoba expressly granting you the right to use such distinctive signs, you shall agree to use them in accordance with the provisions of the agreement, as well as all the applicable provisions of the Terms/Conditions and guidelines of the Editor of Jobijoba regarding the use of distinctive signs, as occasionally amended.

9.4 The Editor of Jobijoba acknowledges and agrees that no ownership rights on the Content (including all intellectual property rights relating to that Content, and regardless of the protected territory and whether these rights have been registered or not) that you submit, post, transmit or publish on the Services, or through the Services, will be transferred to him or assigned by you or your licensors under these Terms and Conditions. Unless otherwise agreed upon in writing with the Editor of Jobijoba, you agree to be responsible for the protection of the Content and application of the rights pertaining to such Content. The Editor of Jobijoba is not obliged to do so on your behalf.

9.5 You shall agree not to remove, obscure or alter any information related to ownership rights (including statements relating to copyright and trademarks) which may be affixed to or contained in the Services.

9.6 Unless specifically authorised in writing by the Editor of Jobijoba, you acknowledge that, in your use of the Services, you will not use any trade mark, service mark, trade name, logo of any company or organization such that it may lead, intentionally or unintentionally, to confusion concerning the owner or authorised user of such marks, names or logos.

10. Ending your relationship with the Editor of Jobijoba

The Terms and Conditions will continue to apply until they are terminated by you or the Editor of Jobijoba in the terms outlined below.

11. Limitation of Liability

No clause in these Terms and Conditions shall exclude or limit the liability of the Editor of Jobijoba for damages which the applicable law prohibits the exclusion or limitation.

The Editor of Jobijoba, its Subsidiaries and Affiliated companies and licensors shall not be liable to you :

  • for indirect or consequential damages you may suffer, and for any shortfall (whether incurred directly or indirectly), any loss of goodwill, clientele or reputation, or any loss of data suffered by you;
  • any loss or damage you may suffer resulting from:
    • the fact that based yourself on the completeness, accuracy or effectiveness of any advertising, or any relationship or transaction between you and any advertiser or sponsor whose advert appears on the Services;
    • all changes that the Editor of Jobijoba can make to the Services or the permanent or temporary disruption in the provision of the Services (or any features of the Services);
    • erasure, alteration or failure to save any Content and other communications data stored or transmitted through the use of the Services;
    • your failure to provide the Editor of Jobijoba with accurate account information;
    • your failure to maintain the security and confidentiality of your password and your account information.

The limitations of liability set out above will apply, whether the Editor of Jobijoba has been informed or not or is aware or not of the possibility of the occurrence of such damages.

12. Advertising banners

Some of the Services provided by the Editor of Jobijoba are financed by advertising revenues and so banners and promotions may be displayed. These adverts can target the content of information stored in the Services, queries made through the Services or other information.

The terms and scope of adverts published by the Editor of Jobijoba in the Services can be modified without notice.

In return for access to the Services and their use provided by the Editor of Jobijoba, you agree that the Editor of Jobijoba shall display banners in them.
